What Is Jessica's Law in Kansas?
Jessica's Law created stricter penalties for people convicted of sex crimes. If you are convicted of a sex crime involving a child under the age of 14, you could face the following penalties:
- First-time offenders have a minimum 25-year prison sentence
- Second-time offenders face a minimum of 40 years in prison
- Third-time offenders will receive a life sentence with no possibility of parole
It does not matter if the child actually was under 14. For example, the Johnson County sheriff's department conducts undercover investigations in online chat rooms. If an officer holds herself out to be 13 years old while chatting with you online and you travel to meet her, you could be convicted of a sex crime with a child, regardless of the officer's actual age.
If you are convicted of any sex crime, you will also need to register as a sex offender. In Kansas, you will need to register with the national sex offender registry for a minimum of 10 years.
Experienced Trial Attorneys by Your Side
Sex crime charges involving children under 14 do not easily lend themselves to plea agreements. More often than not, your case will have to go to trial. It is important to have a skilled trial attorney to protect your rights in the courtroom.
In addition to countless case dismissals and plea agreements, attorney Scott Toth has handled more than 100 jury trials. He has represented clients at the federal and state level. As a former prosecutor, he knows what it takes to argue effectively in front of a jury and he will vigorously defend your interests inside and outside of the courtroom.
